These General Terms and Conditions of Use ("Terms") are entered into by and between you and Belvivere.com (“Belvivere”). In consideration of your use of and access to this Internet site and the promises and obligations herein, and intending to be legally bound, you and Belvivere hereby agree as follows: Your access to and use of the Belvivere website is subject to these Terms, as well as any modifications issued by Belvivere to these Terms, and all applicable laws and regulations. BY USING THIS SITE, YOU AGREE TO AND WILL BE DEEMED TO BE BOUND BY THESE TERMS. If you do not want to be bound by these Terms, please do not use the Belvivere website.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.

All prices displayed on Belvivere.com website are quoted in U.S. dollars. Belvivere reserves the right without prior notice to discontinue or change specifications and prices on products and services offered on the Belvivere website without incurring any obligation to you. Products displayed on the Belvivere website are available while supplies last. In the event that a product or service is listed at an incorrect price due to mistake or typographical error, Belvivere shall have the right to refuse or cancel orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged.

Belvivere reserves the right at any time after receipt of your order to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation from Belvivere, for any reason. Belvivere reserves the right to limit the order quantity on any item and to refuse service to any customer without prior notification. The receipt by you of an order confirmation does not constitute Belvivere’s acceptance of an order. Prior to Belvivere’s acceptance of an order, verification of information may be required.

14. Dispute Resolution

Mindful of the high cost of litigation, not only in dollars but also in time and energy, both you and Belvivere agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the Sites, or the breach, enforcement, interpretation, or validity of this Agreement or any part of it ("Dispute"), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. Notice shall be sent :

2.	to you at: your last-used billing address or the billing and/or shipping address in your online profile.

Both you and Belvivere agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any litigation or filing any claim against the other party.
